As with the majority of the mortgage and housing market in general, the commercial mortgage sector has suffered as a result of the overall economic downturn. Throughout the UK the past year or so has seen existing successful companies through to viable start up companies struggling to raise sufficient finance because of the dwindling numbers of commercial mortgage products that were available on the market. This has inevitably left a good proportion of small to medium sized firms, entrepreneurs and investors with little scope to pursue or develop a wide range of business activities without having to pay a premium to do so.

However, as the British summer weaves its way along in a multitude of seasonal swings, the commercial mortgage market has also begun to heat up as there appears to be some funding lines opening up as lenders appear to be returning to the market. This will have the knock on effect of increasing competition which will provide the stimulus needed for more products to become available for those looking businesses looking for a commercial mortgage to purchase their premises or for commercial property investors looking to finance either a purchase or remortgage.

To illustrate this rise in positivity, buy-to-let and commercial mortgage specialists Mortgages for Business has recently reported to have seen a 41% increase in new mortgage cases since January 2009, which it attributes to an upturn in the number of property investors returning to the market.

With the residential housing market also showing tentative signs of growth it appears that commercial mortgage transactions are showing the healthiest signs of improvement with the number of new cases more than doubling over the first six months of the year.

Commenting on the current commercial mortgage market conditions, David Whittaker, managing director of Mortgages for Business, says: “There are the first glimpses of a shift in the commercial sector, with enquiries and cases on the increase. This is significant as the commercial property sector has suffered horrendously over the past two years, but, we appear to have turned a corner. With the number of mortgage cases gaining momentum it is clear that banks are open for business and willing to lend, as long as the numbers stack up.”

Further momentum will continue in the form of increased funding becoming available to lenders which, hopefully, will in turn become available to borrowers through increasingly competitive commercial mortgage products. There is no doubt that there are some businesses that will continue to struggle but as with any market downturn, winners will emerge and it will be those firms that have greater control over their financial situation that will come through relatively unscathed. The commercial mortgage market is showing signs of some recovery but there is still some way to go. There are promising signs that a degree of positivity has returned to the market, so with this in mind the commercial mortgage market is certainly one to watch for in the later part of 2009 and early 2010.

BATON ROUGE -- The board that operates the state-run insurer of last resort will seek a 9.2 percent statewide rate increase at its meeting Thursday, but some policyholders may see a decrease in their premiums if those rates are approved, the chief executive officer of the company said today.

John Wortman, who oversees the day-to-day operations of the Louisiana Citizens Property Insurance Corp., said the average policyholder, who now pays about $1,800 a year, will see premiums go to about $1,966 annually if the proposed rates are approved.

Wortman said the increase is expected to generate about $20 million a year in additional revenue for the company, bringing it to about $245 million a year.

By law, Citizens' premiums must be at least 10 percent more than premiums of private insurance companies that write at least 2 percent of the business in a parish. Wortman said the 10 percent mark-up is include in the proposed 9.2 percent rate hike because the new rates are based on existing premiums that have already been marked up.

Citizens insures about 125,000 policies in the state, about 45 percent of that in Orleans and Jefferson parishes -- roughly 56,000 policies.

Wortman said based on preliminary numbers, about two-thirds of Citizens customers may see rate decreases in the two parishes and one-third may see rate increases. Statewide, he said, about 70 percent of the policyholders may see an increase and 30 percent a decrease.

Wortman said Thursday's meeting will break out the increases and decreases by parish. Insurance Commissioner Jim Donelon, whose office must approve or reject the rates of Citizens and other insurance companies, said last-minute surveys and calculations were still being run on the parish rates.

Preliminary data show that the variance in the premiums charged may be 40 percent -- from a decrease of 10 percent in some areas to a 30 percent increase in others, based on location and type of policies written, Wortman said.

Donleon said the new rates "could go either way (higher or lower) but only incrementally" when the board receives the data Thursday.

The board approved a rate increase of 14 percent last year but Donelon's office reduced that to a 7 percent rate hike. The Citizens board last month proposed a 10.1 percent rate increase but postponed action on the request for a month.

In the meantime, Donelon said, a more refined request of 9.2 percent is pending. State law exempts from the mandated 10 percent markup through Aug. 15, 2011, 12 parishes hit hardest by Hurricanes Katrina and Rita in 2005: Calcasieu, Cameron, Vermilion, Iberia, St. Mary, St. Tammany, Orleans, Jefferson, St. Bernard, Plaquemines, Terrebonne and Lafourche.

"I'd like to get the rate (increase) filed (with Donelon) in August and approved in September,'' Wortman said. "We'd like to get it moving.''

The board can approve it, reject it or defer action. After it clears the board, Donelon's office must approve it, reject it or send it back to the board for more work.

Once approved, Wortman said, the new rates would go into effect Dec. 1 for new policies and Feb. 1 for policies that are being renewed.

The board Thursday also is scheduled to take up the imposition of a 5 percent assessment on all property insurance policies in the state to help pay off $1 billion in bonds Citizens issued in the wake of the 2005 hurricanes to keep the company solvent.

The issue came up at the July board meeting but State Treasurer John Kennedy's representative on the board, Jim Napper, questioned the need for 5 percent assessment when all that was needed to help service the bonds this year is a 4.3 percent assessment.

The 5 percent assessment would generate about $100 million and the 4.3 percent would bring in about $86 million to service the bonds this year.

Napper wanted a legal opinion on whether state law allows the board to impose an assessment higher than what is needed for the bonds, essentially generating a surplus of $14 million.

Napper said the $14 million would amount to "an excess surplus'' that state law may not allow.

Mortgage Laws and the Case for Moving Insurance Across State Lines

The most common argument against allowing health insurance to move across state lines is that each state has their own state laws governing health insurance and thus it is not practical to do this. Different states have different levels of regulations and allowing health insurance to cross state lines would turn into chaos and take power away from the states the critics say. The critics say that insurance companies will simply set up shop in those states with the loosest regulations .

Today, I asked Sandy Praeger to share her perspective on the issue. Praeger is insurance commissioner for Kansas and president of the National Association of Insurance Commissioners.

Praeger told me she was against lifting restrictions on the sale of insurance across state lines.If the change was implemented, here’s what she predicts will happen: Insurers will set up shop in states with few regulations and market low-cost policies to people across the country. These policies will offer minimal coverage and appeal primarily to younger consumers.

“It will be a race to the bottom,” Praeger said, and there will be “very few consumer protections. … You’ll have plans that don’t cover the benefits that people need. … And healthy people are going to buy those less costly plans, because they don’t think they need [the protection].”

Now, I have dealt with something similar in mortgages for years. In fact, in mortgages, there are numerous state laws and federal laws. For instance, in Illinois, there is something called the Illinois high cost law. This law does two things. First, it sets a maximum rate that any borrower can be charged on any loan. Second, it sets the maximum fees that can be charged on any loan, 5.5%. My only experience with Illinois high cost was when a protege of mine tried to do a difficult loan that was deemed illegal at the end of the process. This was a loan on an investment property with a borrower with a marginal credit score and they were putting little down to purchase the property. As such, the rate on the loan approached 11%. Everything seemed fine until we got the loan ready to close and the bank realized it couldn't be done because the rate was illegal. In fact, there was no way to make the loan legal.

Illinois high cost also comes up often for FHA loans. That's because there is a 1.5% fee that FHA charges up front for Mortgage Insurance Premiums. As such, before anyone charges a single dime, there is already 1.5% of the 5.5% used. Of course, different banks have different interpretations of whether or not that 1.5% should be counted in the overall 5.5%. So, often there are disputes between bank and broker about whether or not a loan has exceeded the Illinois High Cost law.

That's just in the state of Illinois. The state of Minnesota has created all sorts of state laws to prohibit "predatory lending". The state of North Carolina also has very strict "predatory lending" laws. If a bank wants to do business in any state, they must follow the laws of that state along with federal laws as well rules set out by Fannie/Freddie and FHA. Sometimes, laws become so burdensome that banks actually stop doing business in a state. For instance, HB 4050, in my county of Cook, became so burdensome in 2006 that dozens of banks simply stopped doing business in that County.

Why do I point this out? It's because mortgages is among the most heavily regulated industries in the country. Anyone who has ever closed on a loan knows full well just how regulated it is since they sign hundreds of pages worth of closing documents in response to regulation. We have something called a regulation z. That's because there are so many regulations that they span the alphabet. Each individual state sets out their own regulations along with federal regulations. Yet, banks are able to sell loans across state lines even despite this hyper regulation.

In other words, the mortgage industry allows for mortgages to "cross state lines" despite the plethora of competing regulations. In fact, banks, much like insurance companies, set up shop in one state and then sell mortgages across state lines. They are able to figure out how to navigate all of the state laws, federal laws, and other regulations, and still be able to produce their product in all fifty states at one time. The regulations and complexity of mortgages is no less than is the regulations and complexity of health insurance. Yet, banks are able to figure out how to sell mortgages across state lines, and no one is claiming that you can only get a mortgage from a bank in your home state. In the same way, we could figure out how to sell health insurance across state lines.

Indonesian police have recovered a laptop that they believe belonged to one of the bombers of Friday's twin hotel attacks in Jakarta, the country's official news agency said Sunday.

The laptop contained information and codes that the attackers may have used to communicate with each other, the state-run Antara News Agency said.

The computer was found in a room at the Ritz Carlton, one of two hotels targeted Friday. The other site was the JW Marriott.

The blasts killed nine people -- including at least two presumed suicide bombers -- and wounded more than 50.

Anti-terrorism officials are investigating the links between the attacks and Noordin M. Top, the suspected leader of a small Jemaah Islamiyah splinter group. The group has ties to Osama bin Laden's al Qaeda terrorist network, but so far there has been no claim of responsibility for the latest attack.

Top is reportedly an officer, recruiter, bomb-maker, and trainer for the group, which was involved in a previous attack on the Marriott -- in August 2003 -- as well as attacks on a Bali nightclub in 2003 and the Australian embassy in Jakarta in 2004, according to the FBI.

Among the victims who have been identified by Indonesia's health ministry, two were Australian, and one each from New Zealand, Singapore and Indonesia

Among the wounded were six U.S. nationals, according to the State Department.

On Sunday, Australian Prime Minister Kevin Rudd confirmed one of the victims, saying Garth McEvoy was the first government official to be killed by a terrorist attack in the line of duty.

Rudd also said two other Australians were presumed dead.

Indonesia's National Police Chief Gen. Bambang Hendarso has said the type of explosives found were similar to those found in a recent raid on a home in West Java that was linked to Top.

"We cannot clearly determine at this time if these bombings are linked to Noordin Top's network. We have only established similarities in the explosive cache that were found in the island of Java and the Bali bombings," police said.

Closed-circuit television footage from the Marriott shows a man, sporting a baseball cap and pulling a wheeled suitcase, heading toward the hotel's lobby-level restaurant seconds before the deadly blast.

Didik Ahmad Taufik, the Marriott's security supervisor, told reporters Saturday that a man, matching the image on the security camera footage, was walking "awkwardly" into the hotel's restaurant about 30 minutes before the blast.

The man told Taufik he was at the hotel to deliver an item to his boss.

Taufik said he asked a security guard to accompany the man as he made his delivery.

"But unluckily, a few minutes after that, I heard an explosion and was hit by debris from the ceiling," Taufik said, according to Antara.

One of the suspected bombers had been staying at the hotel since June 15, he said.

The bombings at the two luxury hotels -- which are connected by an underground tunnel -- happened shortly before 8 a.m. (9 p.m. Thursday ET). Both blasts struck the hotels' restaurants. The hotels are frequented by international visitors and many foreign nationals.

A former California police officer accused of sexually assaulting a motorist during a traffic stop pleaded guilty in federal court, federal prosecutors said Friday.

Federal prosecutors charged Feliciano Sanchez with deprivation of rights under color of law.

Feliciano Sanchez, 34, admitted in court Thursday that while on duty on May 16, 2007, he pulled over a female driver in a traffic stop and forced her to perform oral sex on him, according to a news release from U.S. Attorney Thomas O'Brien, who heads the office for the Central District.

Sanchez, then of Los Angeles County's Bell Police Department, stopped the woman for speeding or weaving down the road, said central California U.S. attorney spokesman Thom Mrozek, citing court documents.

After learning the woman, identified as R.H. in court documents, did not have a driver's license with her, Sanchez told her he suspected her of drinking and her car would be towed, Mrozek said.

Sanchez offered to drive R.H. to her job, but instead drove her to the parking lot of an auto repair outlet in Bell, Mrozek said.

Sanchez placed his hand on his gun and forced her to perform sex on him in his patrol car, Mrozek said. Afterward, Sanchez drove R.H. to her work place, Mrozek said.

"Officer Sanchez brutalized a person he had sworn to serve," O'Brien said in the release. "As a result of his criminal conduct, Mr. Sanchez now faces a substantial amount of time in federal prison. His conduct eroded public confidence in law enforcement and cast a pall over his former colleagues who obey the law, proudly working to preserve public safety."

Federal prosecutors charged Sanchez with a civil rights violation, according to the release.

The crime carries a maximum penalty of 10 years in prison upon sentencing. Sanchez has been held without bond since his arrest in May 2007, Mrozek said. Sanchez's sentencing is scheduled for November 18.

They find this ark and, not ones to buck convention, they release the beast and can only stop it with the help of Noah's magical staff. One of my favorite things to do on a clear summer evening in Seattle is to sky watch, and this weekend will be a treat for anyone with an inexpensive pair of binoculars or telescope.

When I first started losing sleep to enjoy the evening canvas, there were more than a few occasions where I thought I was witnessing my first UFO. If you consider yourself a novice to sky gazing, meaning you can't remember the last time you spent more than a minute or two wishing on a star, I'll have you know how easy it is to make the same mistake.

In fact, sightings of the planet Jupiter, the International Space Station and traveling satellites make up nearly 75 percent of UFO reports during certain times of the year, and I suspect this week's unique configuration of planets will offer many opportunities for the newbie sky-watcher to cry wolf.

So for my first story on the evening sky, I thought I would share my own mistakes with the reader so that you can enjoy the show without worrying about alien abductions or being overpowered by strange craft. Here's what's happening this weekend on the real life planetarium that is worth noting.

The wee hours of Saturday morning offers an eye-popping surprise with a waning full moon to the south and Jupiter hanging loose near the 5 o'clock mark. This configuration is so stunning that the sight of these two orbs so close together might make you squint against the brightness, but once your eyes get adjusted to the stark contrast between the moon and sky, see if you can locate all four of Jupiter's four Galilean moons.

I guarantee that it will be rare treat worth staying up for and here's why: Jupiter's moons are currently going through what's known as a series of occultations and eclipses-- meaning they're moving around like a game of Pong, so it’s neat to get a glimpse of them when they're in close proximity to one another.

If you were able to find those moons and you want to continue with the hunt, Monday you will have a prime opportunity because Titan, Saturn's largest moon can be found counting about four rings to Saturn's east. Of course you'll need to get your hands on a small telescope, and an identification guide wouldn't hurt either. I found one in the July issue of Sky & Telescope on page 47, but you'll need to find your own copy if you aren't able to find one online.

If the sky continues to keep its clear complexion in the Seattle area, The International Space Station (ISS) can be seen entering the sky at least twice every evening into the week, and if you've never waited for its approach you're missing one of my favorite G-rated cheap thrills.

On Saturday it approaches from the SW at about 9:40 and meanders towards the NE for a total of five or six minutes, depending on where you're standing. Customizable sky charts and satellite itineraries are easily found and downloadable for free on the heavens-above website http://www.heavens-above.com/ so if you haven't found your own favorite astronomy site, check it out. While nothing too fancy, it is user friendly and easy on the virtual memory.

Before the sun comes up, follow the progress of planet Venus as she travels away from a less dazzling Mars, and this week both planets can be found smack dab between two of summer's celebrity star clusters, the Pleiades and their nemesis the Hyades. Look for the brightest star at the head of the constellation Taurus and you'll be looking at one of the brightest stars in the sky. If you can't find the bull's eye readily, first try locating Orion, then look at the three stars of the belt from left to right. Do you see the twinkling sun at the top of the line? That's our friend Alde.

Worth noting is that since the Earth is moving at its slowest orbital speed right now, summer is the longest season in the northern hemisphere. So while the nights are short, they are also clear more frequently than in winter which offers us the best opportunities for sightings. Remember, it's not quantity, but quality that counts, and a cloudless night is what you need for optimal nighttime viewing.

As far as those UFOs go, I do know from my own first hand experience that the opportunities to witness the unexpected increase dramatically once you sit still for a spell and fix your peepers on the evening sky. Hopefully after reading this you'll at least have a better idea of what you're looking at in the night sky so when you do see the "unexpected," you won't blame Jupiter and keep those MUFON folks up all night answering the phone for no good reason.

Lugo has actually hit better this season than in his other two seasons with Boston. That’s not saying much, and his career line with Boston is still .251/.319/.346. Defensively, Lugo hasn’t been much better in Boston, posting UZR/150 of 4.3, -2.6, and -43.2. Okay, obviously the last one is due to an extremely small sample size; if you assume he’s more like -10 than -43, you get the picture of a below average defensive shortstop, but hardly the worst in the majors.

What happened to him? His ISO has sat well below .100 the past two seasons after never touching .105 or lower the rest of his major league career. His walk rates are still quite solid, same with his strikeout rates. His BABIP hit a rough spell in 2007 but has since bounced back fine. He hit a lot of grounders last season, and now he’s hitting a lot more fliners. Lugo’s tendency to hit a home run has all but vanished. He still makes contact, doesn’t swing out of zone, and he’s seeing fewer balls in the zone.

The only thing that makes sense is that Lugo’s physical skills have decayed. He is a shortstop in his mid-30s, but he’s also hovering around replacement level. ZiPS projects Lugo to hit league average, and depending on where he plays on defense, he shouldn’t be that poor. Maybe Lugo’s body has decided enough is enough, or he really misses playing with his brother (Ruddy Lugo was his teammate during his time in Tampa Bay) or he simply doesn’t feel comfortable in Boston and never did.

If Boston is covering most of the salary and willing to take back just about anything to clear the roster spot, teams have done a lot worse than taking on Lugo and winding up with an average bat and probably below average glove at either middle infield position.

At only 0.8 inches, the remote for the Panasonic TC-P54Z1 is thicker than the TV itself.

The 54-inch high definition television, which only comes in one size, is completely wireless, said Thomas Electronics manager Trevor Thomas.

For the TV to be so thin, the set had to be made wireless without any connector cables, Thomas said, adding a tuner box and wireless transmitter are used to transfer the information to the screen.

“As long as (the tuner box) is in the room, it sends the information through a secure wireless network of its own.”

Mounted on a wall, the TV is “realistically as thin or thinner” than most framed pieces of artwork, he said.

When the model was initially released in April, it came with a $10,000 price tag. The price has since dropped to $8,000 to make it more attainable, Thomas said.

The thinness of the TV isn’t its only feature — it has a game mode, making it safe for video games, and has a Viera Image Viewer, making it ideal for looking at photos.

A year later, three suicide bombers targeted two tourist spots on the resort island of Bali. The bombings -- two at the cafes near Jimbaran Beach and one at a restaurant in Kuta's main square -- killed 19 people and wounded at least 132, according to hospital officials.

Despite the string of bombings, presidential spokesman Dino Patti Djalal said Indonesia has made strides in addressing terrorist groups. "We have made significant progress in curbing the activities of terrorists," the spokesman said.

The Invisible Glove: Jackson Presides Over Parallel-Universe Charts

What’s stronger and more impregnable than the news judgment of network television, the fiscal wisdom of Los Angeles City Hall, or a celebrity’s last will and testament?

Answer: Billboard’s chart rules.

Even as the early summer of 2009 has seen TV newscasters ignore global unrest in favor of Michael Jackson death coverage; L.A. spend millions amid a state budget crisis to police a Jackson memorial; and Jackson’s heirs treat his final documented wishes as mere suggestions, Billboard has not budged.

Since the early ’90s, the magazine has ruled that songs and albums more than a couple of years old will not appear on its flagship lists, the Hot 100 or the Billboard 200, respectively. That goes even if an old disc is outselling every current title, or if an old song is booming out of car radios from coast to coast.

I don’t blame Billboard for standing firm on its rules amid all the Jackson hoopla, but it has made the last couple of weeks surreal for chart-watchers like me. The two big lists have looked placid on the surface, but everybody knows the real action is elsewhere: Jackson has had the top-selling album(s) for two weeks now (and possibly a third soon), and his songs have earned Top 10-level sales and airplay — none of which is reflected on these flagship charts.

But nothing’s stopping us from imagining what these lists would look like if Jackson were allowed to appear on them. If he’d been allowed on last week’s Hot 100, for example, Jackson would have beaten a 45-year-old record by the Fab Four. Let’s explore what both of the big charts would have looked like in this parallel universe.

For albums, Billboard does it for you: their Comprehensive Album Chart ranks all albums side-by-side regardless of age, accurately reflecting Jackson’s postmortem prowess. For the past two weeks, his compilation Number Ones has been the country’s top-selling album — this week, with the staggering sum of 339,000 discs, up 215% from the prior week’s already-fat sales. Thriller is No. 2 with 187,000, up 86%.

(These latest numbers reflect the first full seven-day chart week after Jackson’s death; the previous week’s charts included just three and a half days of sales after his Thursday passing. Even in that limited time, Jackson managed to outsell any other act for the week both in albums and online.)

Now, let’s give Billboard their due. They’ve been really good about disclosing all these sales figures, and they’re not hiding anything. They’re kind of making this up as they go, because normally the sales of catalog discs aren’t this interesting; never in SoundScan’s 18-year history has a catalog album outsold the best-selling current album in the country. (If SoundScan had existed in August 1977, doubtless a couple of old Elvis Presley discs would have outsold Fleetwood Mac’s dominant Rumours for a week or two.) Last week’s top album on the flagship Billboard 200: the Black Eyed Peas’ The E.N.D., with 88,000 sold. This week, it’s the compilation NOW! 31, with 169,000. In both cases Jackson’s Number Ones handily outsold the top current disc, this week, by a margin of about two-to-one.

Billboard’s Comprehensive Albums list is normally a feature offered only to premium subscribers, but for the last two weeks the magazine has been posting the chart on its public Web site, allowing the general public to witness Jackson’s sales feats. As well, all of Billboard’s news coverage has prominently explained how the albums are selling and what charts they appear on.

However, as forthright as Billboard has been about Jackson’s album sales, they haven’t done much to clarify how his singles are faring against current hits. On the positive side, the sales-based Digital Songs chart has no recurrent rule, meaning old songs are allowed to compete there (see below — this week, Jackson owns half of the Top 10 downloads). But none of these chestnuts are allowed to appear on the Hot 100. And it’s no mean feat to try and guesstimate it yourself, because the Hot 100 uses a more intricate formula — including sales, airplay, and online streaming impressions — than the all-sales Billboard 200. In other words, Billboard might as well tell you how the old albums are doing; any SoundScan subscriber could figure it out, anyway. But creating a parallel Hot 100 is real work and not worth it to them.

So allow me. With data help from a nameless industry mole to whom I owe a drink, here’s what the Top 30 of last week’s Hot 100 would have looked like if Jackson had been allowed to chart. This is a back-of-the-envelope calculation that Billboard might quibble with, but I’m confident that it’s more than 90% accurate. Jackson’s “hits” are highlighted in bold.

Shocking? Toward the top, not really—Jackson’s biggest “hit,” “Man in the Mirror,” would have been no threat to the Black Eyed Peas for the No. 1 slot. Also, none of these songs would have improved its chart history: each peaked higher in its original 1980s-era chart run than it does here (all were Top 10 hits, most of them No. 1’s).

On the other hand, look at the sheer number of “hits”: 10 in the Top 30, all but one of them in the Top 25! That would have set a record to put to shame everyone from the Beatles to Lil Wayne to Taylor Swift. Also, I don’t have full data for the entire parallel-universe Hot 100, but doubtless Jackson would have scored enough hits in the chart’s lower rungs to beat the Beatles’ all-time one-week Hot 100 record of 14 songs, set in April 1964. So that’s an opportunity lost for Jackson. (Not that he needs to set any more records.)

In case you’re curious, the X-factor that prevents Jackson from being as all-out dominant on this imaginary Hot 100 as he is on the Digital Songs list is radio airplay. Using the top-selling “Man in the Mirror” as an example, in the days following Jackson’s death, the song received 2,827 spins on radio stations across the country; but in that same week, Keri Hilson’s “Knock You Down,” the country’s biggest radio hit, received about two to three times that number of spins. Still, the nearly 3,000 spins for “Mirror” would have ranked it among the top 20 most-played songs nationwide in late June. Radio’s favorite Jackson track, “Billie Jean,” received an even more impressive 4,540 spins.

All of the above data reflects the days immediately after Jackson’s death, when his digital downloads were most torrid and radio attention most intense. In the most recent chart week, covering the full Monday-to-Sunday after his passing, sales and airplay for Jackson’s songs cooled a bit. In a parallel-universe version of the new Hot 100 (real data shown at the bottom of this column), Jackson’s biggest hits would have ranked no higher than “Mirror” at No. 9, with “Billie Jean” holding at No. 11, “Black or White” edging up a couple of slots, and all the other tracks falling a few places. Impressively, however, all 10 of the above Jackson hits would have remained in the Top 40.

With Jackson’s memorial service dominating news coverage this week, next week’s chart (covering this week’s radio and sales activity) might actually show Jackson’s hits moving back up. I’ll be keeping an eye on the Comprehensive Albums chart and my Bizarro-World Hot 100 to see whether the Summer of Jackson persists into mid-July.

(Postscript: Why do recurrent rules—i.e., the exclusion of old stuff—exist, anyway? Because the industry Billboard serves wants it that way. It’s not useful to the labels to know where Journey’s Greatest Hits or “Don’t Stop Believin’ ” rank among current hits week after week. If Billboard included these old albums and singles on the flagship charts, that would leave fewer spaces for emerging hits to make the lists’ lower rungs; imagine being on the label promotional team breaking a new pop act that would have made No. 90 on the Hot 100 if it hadn’t been for an old hit higher up that wouldn’t get out of the way. It became even more important for Billboard to have recurrent rules in place when SoundScan came online in 1991, because the more accurate data revealed that, even as new hits come and go, folks buy certain perennial discs forever. The downside, of course, is that we old-school chart freaks will never again see records riding the big album chart for 15 consecutive years, as Pink Floyd’s Dark Side of the Moon did from 1973 to 1988.)

Here’s a rundown of the rest of this week’s charts:

• Last week, surprising no one, the Black Eyed Peas succeeded themselves at No. 1, as “I Gotta Feeling” knocked “Boom Boom Pow” from the penthouse (final tally: 12 weeks at No. 1).

That puts the Peas in another elite club. Only 10 acts have ever succeeded themselves at No. 1; and if you go by my stricter rules, which exclude an Elvis Presley twofer in 1956 that predates the Hot 100 and two other pairs with featuring-artist credits (Puff Daddy in 1997, Ja Rule in 2002), the number of self-succeeding acts is just seven: the Beatles, Boyz II Men, Nelly, OutKast, Usher, T.I. and the Peas.

Only nine months separate the Peas’ moment of succession and the previous one, by T.I. But that’s an eternity compared with the pileup of singles by OutKast and Usher in 2004; that year, the succession of OutKast’s “Hey Ya!” by “The Way You Move” came a mere 14 weeks before Usher’s “Yeah!” was succeeded by his “Burn.”

• The highest Hot 100 debut of the week falls just outside the Top 10, as mellow-girlypop avatar Colbie Caillat scores her second-biggest hit ever with the Archie-endorsed “Fallin’ for You.” Its ninth-place berth on the Digital Songs chart (118,000 downloads) results in a No. 12 debut, remarkable for a gal whose biggest hit, the fall 2007 smash “Bubbly,” took months to climb to its Top Five peak and whose followup single “Realize” made a tepid No. 20.

• Speaking of Caillat, and also in the never-underestimate-the-power-of-mellow-pop dept.: Late last summer, I compared Caillat’s too-tasteful strummy sound to a then-rising song by Jason Mraz. Well, here we are more than 10 months later, and that Mraz hit is looking to set a chart record — “I’m Yours” is in its 64th week on the Hot 100. That ties Mraz for third place with Carrie Underwood’s slow-rising and slow-falling “Before He Cheats” on the all-time longevity list. One more week, and he ties the second-place hit, a double-sided 1996 Jewel single (“You Were Meant for Me”/“Foolish Games”) that milked a mid-’90s chart aberration into a 65-week Hot 100 run. Then “Yours” has to stick around a full month after that to knock off the all-time champ, LeAnn Rimes’ “How Do I Live,” which charted for 69 weeks in 1997-98.

As we explained here two years ago when Underwood was going for the record, the trick to pulling off a longevity feat is staying above No. 50; that’s the dividing line where Billboard’s recurrent rules kick in and songs older than 20 weeks are removed from the Hot 100 permanently. On this score, Mraz’s hit is doing well: it currently sits at No. 29 and is actually up two notches from the prior week. When Underwood’s hit was gunning for the record, it spent its last month knocking around the 40s, and here’s Mraz still touching the 20s. So it looks like Jewel is toast, and Rimes’ all-time record looks more vulnerable than it’s ever been.

• Boy, the recurrent rules just keep coming up this week, don’t they? The second-highest debut on this week’s Hot 100, at No. 45, is actually a reentry, a never-say-die track from the Ting Tings. And it wouldn’t be there if Billboard didn’t make an exception to its rules, because the song already had a 20-week chart run and was removed a couple of months ago.

Just when it looks like “That’s Not My Name” is about to peter out in America, it catches on with a few more radio stations. A boost in current airplay (according to news reports, even Radio Disney is catching on, with more than 300 spins on its syndicated kiddie network) prompts Billboard to allow the reentry by the track, which first appeared on the list last December. This isn’t even “Name”’s first comeback — it made a Hot 100 reentry last February, which I reported here. This third entry, just five slots below the Top 40, is its highest yet, and the fact that it’s fueled by radio is a good sign that it might drift higher and finally give the hit British act its first bona fide U.S. hit.

• How hot at country radio is Brad Paisley? So hot that his chart-toppers don’t behave themselves and fall away after they’ve peaked.

The Hot Country chart is all-airplay and, as we’ve discussed here before, carefully managed by the Nashville promotional establishment; songs adhere to regimented patterns. For the average country No. 1 hit, a typical chart run consists of a long, slow, steady climb, a week or three on top, and then a fast drop. (Billboard contributes to this by setting its recurrent rule such that songs disappear off the Country chart after they fall out of the Top 10 — one of the most rapid removal rules on any list except Adult Contemporary.) Just look at “Out Last Night” by Kenny Chesney, which was No. 1 a scant two weeks ago: it’s already down to No. 8, and it’ll be removed from the entire 50-position list when it (most likely) slips from the Top 10 next week.

But, by contrast, look at Paisley’s “Then”: his 10th No. 1 single in a row, it spent three weeks on top, the last of which was four weeks ago. But it won’t leave the Top Five. After slipping from the penthouse to No. 2, it actually held at No. 4 for two weeks, and this week it slips just one measly notch to No. 5. These are the kinds of poky patterns we expect from declining hits on the Hot 100 or R&B/Hip-Hop charts (see the former No. 1’s by Black Eyed Peas on the former and Keri Hilson on the latter, each still in the Top Five), but not Country. Which, again, says that Paisley is sneaking past the likes of Chesney, Rascal Flatts, Tim McGraw and Toby Keith as the format’s biggest radio star.

• Let’s make a year-end prediction right now: If Anberlin’s “Feel Good Drag” isn’t the No. 1 Alternative song of 2009, I’ll eat my hat. Now in its 40th chart week, the former Modern Rock No. 1 song actually moved up one notch last week and is back down that same one notch to No. 6 this week. Other songs by the likes of Green Day and Kings of Leon have had flashier chart runs, but “Drag” has outlasted virtually every chart-topper that’s come before or after it this year.

Further down the Alternative list, emo stalwarts Taking Back Sunday score only their second Top 10 hit in a decade-long career, as “Sink into Me” sneaks up one notch to No. 10. They previously reached No. 8 at Modern Rock with 2006’s “MakeDamnSure.”

wah lagi - lagi indonesia dikejutkan lagi dengan aksi teroris, kenapa ya masih ada setelah lama mereka g terdengar lagi?

Ledakan mengejutkan daerah Lingkar Mega Kuningan, Jakarta Selatan, pada pagi hari ini. Namun belum ada informasi yang mendetil terkait ledakan ini yang membaut para pegawai di sekitar area tersebut berlarian ke luar.

Berdasarkan informasi yang diterima TMC Polda Metro, Jumat (17/7/2009), menurut salah seorang pekerja yang berada di lokasi, ledakan terdengar dari belakang Hotel JW Marriot.
Asap juga terlihat membumbung tebal di lokasi tersebut. Sementara dikabarkan ledakan yang sama juga terdengar di Hotel Ritz Carlton.
Para pegawai yang berlokasi di area Mega Kuningan saat ini berada di luar gedung masing-masing untuk menyelamatkan di pada sekira pukul 08.00 WIB terjadi di restaurant Ritz Carlton, Jalan Mega Kuningan, Jakarta Selatan.
Ledakan menghancurkan ruang dan kaca restauran yang letaknya persis di dekat pintu masuk. "Dua kali ledakan di restauran," kata juru masak restauran.
Ledakan kedua terjadi di Panin Bank yang letaknya berdekatan dengan Hotel Ritz Carlton. Sejumlah orang terlihat terluka dan dilarikan ke rumah sakit.
